Welcome to TBAfit. By accessing or using our platform, services, API, or any associated website (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not access or use the Platform.
By creating an account, completing an assessment, or calling our API, you acknowledge that you have read, understood, and agree to be bound by these Terms.
TBAfit provides: Move-IQ Assessment, ATLAS AI engine, BluePrint builder, Move-IQ MCP API (governed by a separate API License Agreement), and tiered Subscription Services (Core, Pro, Elite).
3.1 Account Registration: You must provide accurate information and are responsible for all activity under your account.
3.2 Practitioner Accounts: Trainers, PTs, and movement specialists. Practitioners warrant they hold applicable licenses/certifications in their jurisdiction.
3.3 Individual Accounts: Individuals complete self-assessments. Individuals acknowledge the Platform is a fitness/wellness tool, not medical care.
3.4 Practitioner Obligations: Obtain client consent; use results for fitness programming only; do not diagnose or treat medical conditions.
4.1 Subscription Tiers: Core / Pro / Elite — current pricing on the Platform. Prices subject to change with 30 days' notice.
4.2 Billing: Monthly or annual advance billing via Stripe.
4.3 Failed Payments: May result in suspension of paid features.
4.4 Cancellation: Any time via account settings. Takes effect end of billing period. No partial-period refunds.
4.5 Price Changes: 30 days' notice required.
THE PLATFORM IS NOT MEDICAL CARE. THE PLATFORM DOES NOT PROVIDE MEDICAL DIAGNOSIS, MEDICAL ADVICE, OR TREATMENT OF MEDICAL CONDITIONS. No assessment, score, or ATLAS insight constitutes a medical diagnosis. Consult a qualified healthcare provider before beginning any exercise program.
You agree not to: use for illegal purposes; reverse engineer any component; scrape/bulk-download data; share credentials or API keys; create a competing product; make medical claims; misrepresent TBAfit as medically certified or endorsed.
7.1 TBAfit Ownership: Platform, Move-IQ model, ATLAS engine, BluePrint, and all data are exclusive property of TBAfit / The Body Academy.
7.2 User Data License: You grant TBAfit a non-exclusive, royalty-free license to use assessment data for product improvement and aggregate analytics.
7.3 Practitioner Programs: Programs created by Practitioners remain owned by the Practitioner.
7.4 No Reverse Engineering: You may not reverse engineer, clone, or reproduce Move-IQ or ATLAS IP.
Collected, stored, and processed per our Privacy Policy at /privacy.
Access to the Move-IQ MCP API is governed by a separate API License Agreement. By requesting or using an API key, you agree to the terms of that agreement. Scope is locked: Move-IQ only — no BluePrint, ATLAS, or other services via the API.
TBAfit shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability capped at fees paid in the preceding 12 months.
You agree to indemnify TBAfit against all claims arising from your violation of these Terms or misuse of the Platform.
12.1 By You: At any time via account settings. No refunds.
12.2 By TBAfit: At any time for material breach or if your use poses risk to the platform.
12.3 Effect: Access and API keys immediately cease upon termination.
Material modifications communicated with 30 days' notice. Continued use constitutes acceptance.
Laws of the State of New York, USA. Disputes resolved per Section 15.
15.1 Arbitration: AAA Commercial Arbitration Rules in New York, NY.
15.2 Class Waiver: You waive all rights to class action lawsuits or class-wide arbitration.
15.3 Injunctive Relief: TBAfit reserves the right to seek injunctive relief in any court.
16.1 Entire Agreement: These Terms + API License Agreement + Privacy Policy.
16.2 Severability: Unenforceable provisions limited/eliminated; rest remains in force.
16.3 Force Majeure: No liability for failures beyond reasonable control.
16.4 Waiver: Failure to enforce a right is not a waiver.
16.5 Assignment: TBAfit may assign without notice; you may not assign without consent.
